CHARTER AMENDMENT RESOLUTION

A RESOLUTION OF THE MAYOR AND TOWN COUNCIL OF THE TOWN OF LANDOVER HILLS, MARYLAND, adopted pursuant to the authority of Article 11E of the Constitution of Maryland and Section 13 of Article 23A, of the Annotated Code of Maryland (1957 Edition, as amended) to amend the Charter of the said town, by amending Section 204 of the Charter of the Town of Landover Hills, Maryland, so that the ward boundaries conform to the 2000 census data.
WHEREAS, the Mayor and Town Council are cognizant of their duty to ensure that the current election wards comply with the decisions of the United States Supreme Court regarding one person one vote; and
WHEREAS, it was and remains the intention of the Mayor and Town Council to ensure that the ward boundaries conform to the 2000 statistics of the United States Census Bureau regarding the actual population of the Town; and
WHEREAS, the Mayor and Town Council are mindful of the numerous Federal and State Constitutional, Statutory, and Case Law requirements for the process of redistricting and the conduct of elections; and
WHEREAS, the Mayor and Town Council charged the Town Manager with the duty to compare the official 2000 statistics with the ward populations and adjust the ward boundaries to conform to all legal requirements; and
WHEREAS, the Mayor and Town Council, after several public hearings on this matter, have determined that there should be adjustments to the ward boundaries to ensure parity in population among wards.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN OF LANDOVER HILLS, MARYLAND:
Section 1: That Section 204 of the Charter of said municipal corporation be amended by repealing it and re-enacting it to read as follows:
Section 204. Ward Boundary Descriptions.
The Town of Landover Hills shall be divided into three (3) wards for election purposes as follows:
(A) First Ward: The first ward shall embrace all of that part of the Town lying south [and west] of the center line of Taylor Street (AS EXTENDED WEST-SOUTHWEST TO THE TOWN'S WESTERN BOUNDARY) FROM THE WESTERN BOUNDARY TO THE CENTER LINE OF 72ND AVENUE AND ENCOMPASSING THE EVEN NUMBERED ADDRESSES ON 72ND AVENUE SOUTH OF TAYLOR STREET.
(B). Second Ward: The second ward shall embrace all of that part of the Town lying between the center line of Varnum Street (AS EXTENDED EAST TO THE TOWN'S EASTERN BOUNDARY) and the center line of Taylor Street AS WELL AS THE AREA EAST OF THAT PART OF THE CENTER LINE OF 72ND AVENUE (THE ODD NUMBERED ADDRESSES) RUNNING SOUTH OF TAYLOR STREET.
(C). Third Ward: The third ward shall embrace all of that part of the Town lying [between] NORTH AND EAST OF the center line of Varnum Street [and the southerly line of Defense Highway, which is sometimes called "Annapolis Road", plus all of that part of the Town annexed by Resolution and Ordinance which were enacted and ordained on June 25, 1958, and finalized on October 5, 1958] (AS EXTENDED EAST-NORTHEAST TO THE TOWN'S EASTERN BOUNDARY).
Section 2: That the date of the adoption of this Resolution is November 28, 2002, and that the amendment to the Charter of the Town of Landover Hills hereby proposed by this enactment, shall be and become effective on january 7, 2003, unless a proper petition for a referendum hereon shall be filed by December 28, 2002, and a fair summary of the Amendment shall be published in a newspaper having general circulation in the Town not less than four (4) times at weekly intervals by December 28, 2002.
Section 3: That as soon as the Charter Amendment hereby enacted becomes effective, either as herein provided or following a referendum, the Clerk of the Town of Landover Hills shall send separately, by regular mail, to the Department of Legislative Reference, the following information concerning the Charter Amendment: (1) the complete text of this Resolution; (2) the date of referendum election, if any, held with respect thereto; (3) the number of votes cast for and against this Resolution by the Mayor and Town Council of the Town of Landover Hills or in a referendum; and (4) the effective date of the Charter Amendment.
Section 4: That the Clerk be, and he/she is specifically enjoined and instructed to carry out the provisions of Sections 2 and 3, and as evidence of compliance herewith the said Clerk shall cause to be affixed to the Minutes of this meeting (1) an appropriate certificate of publication of the newspaper in which the fair summary of the Amendment shall have been published; and (2) return receipts of mailing referred to in Section 3, and shall further complete and execute a Certificate of Compliance.
